Easier state buying of Montana food

Beginning July 1, 2025, state buyers can choose Montana-produced food, including by direct purchase. The product must match outside products in quality, be available in enough quantity, and be priced at or only reasonably above the lowest outside bid. A price is "reasonably above" when the buyer finds it reasonable and can pay it from the current budget without new funds. The department issues rules to run this process. The law defines food to include items people eat or drink, and "produced" to include grown, raised, processed, or made.

Annual reports for large state food contracts

Starting July 1, 2025, large food contracts must include annual vendor reports. The rule applies to contracts of $100,000 or more entered into or renewed after June 30, 2025. Vendors report total food purchases and total Montana-produced purchases. If they have the data, they also report Montana purchases by category: meat, produce, alcoholic and nonalcoholic beverages, dairy and eggs, pulse crops, and grain. The department sets the due date. Alcoholic beverage purchases by the Department of Revenue under Title 16 are exempt.
