NIL rights and protections for Montana athletes

If you are a Montana college athlete, you can earn money from your name, image, or likeness. You can sign contracts and hire an agent. Your school or athletic groups cannot punish you, bench you, or cut aid because you use these rights. This right does not require your school to pay you.

Colleges cannot pay you for NIL

Montana colleges and athletic groups cannot pay current or prospective student-athletes for NIL. NIL payments must come from outside parties, not the school.

Rules for athlete NIL deals and disclosure

You cannot sign a paid NIL deal that breaks team rules or conflicts with a school sponsor contract. But rules and contracts cannot stop you from earning NIL money when you are not in official team activities. If you sign a paid NIL contract, you must tell a school official. If you are not yet on the team, disclose when you seek to join. If the school says your deal conflicts, it must show you the exact rule or contract terms.

School rules on NIL in scholarships

A Montana college may put NIL terms in your scholarship. The school may limit NIL use on campus, at school events, or in ads on school property. The school may also act as your agent to manage NIL deals. Colleges can still enforce general conduct codes that apply to all students.
