10% bid security for state jobs

The law requires bid security equal to 10% of your bid for state or other government building or construction projects. The awarding entity may waive this requirement for projects under $150,000. The waiver only applies to projects that meet the law’s definition of building or construction.

Flexible bid bonds, including e-bonds

The law lists acceptable bid security: cash; cashier’s or certified check; bank money order; certificate of deposit; money market certificate; irrevocable letter of credit; bank draft; or a bid bond from a surety authorized in Montana. These must come from an FDIC‑insured bank, an insured credit union, or an authorized surety. Agencies may accept electronic bid bonds that are signed or verified by you and the surety. Agencies cannot require you to use a specific surety company or a particular insurance producer. If your company bids, an authorized person must sign the security, and your bond must match any form the bid request specifies.
