Dog owners are liable if their dog, without provocation, bites a person or a service animal in public or while lawfully on private property in a city or town. Lawful presence includes doing official duties or being an invitee or licensee. Counties may apply vicious-dog rules when a dog harasses, chases, bites, or tries to bite a service animal. Local rules can require control, quarantine, or other measures.
The law makes it a crime to harass, obstruct, or endanger a service animal after being told to stop. It also covers negligently hurting or killing a service animal, or letting your animal harm or intimidate a service team. A conviction is a misdemeanor with a fine up to $1,000. Taking a service animal to deprive its handler is treated as misdemeanor theft. Courts must order full repayment, which can cover the animal’s value, training or replacement, vet care, the handler’s medical bills, training, and lost wages.
