Twice-yearly reports on tribal funding

Beginning July 1, 2025, designated state agencies must report all financial assistance given to tribal governments. Reports must list amounts given directly and through subrecipients, dates, the recipient tribe, the federal assistance listing number (if any), the purpose, and any administrative or overhead costs kept and how they are used. Agencies also list the program used and, for federal funds, any other amounts kept and why. Agencies send these reports to the Office of Budget and Program Planning by August 15 and November 1 each year. The Office compiles and sends a summary report by September 1 and December 1 to the State‑Tribal Relations Committee, the State Director of Indian Affairs, each tribe, and the Legislative Finance Committee, and posts it on the Indian Affairs website. The Secretary of State sends a copy of this law to each federally recognized tribe.

Who must report and what counts

Starting July 1, 2025, the law defines which executive agencies are "designated state agencies" that must follow these rules. Courts and the Legislature are not included. It defines "financial assistance" to include grants, contracts, loans, loan guarantees, property, subsidies, insurance, direct appropriations, other noncash help, and EBT cards. It covers funds passed through third‑party subrecipients and requires agencies to identify whether money is state or federal. It excludes cash aid paid directly to individuals. A "tribal entity" means a tribal nation, tribal council, or tribal government in Montana.
