Insurers must cooperate on Medicaid claims

The law requires insurers and similar payers to share Medicaid eligibility and coverage details with the health department when asked. They must answer the department’s questions about a claim if the claim was filed within 3 years of the service date. Insurers must accept the department’s right to recover payments when Medicaid already paid and the recipient assigned their payment rights. If the department submits a claim within 3 years and starts enforcement within 6 years after submission, payers cannot deny it just for late filing, form type, missing prior authorization, or missing point‑of‑sale paperwork.

Plans only pay covered claims

The law does not make a plan pay for services it does not cover. Administrators or contractors do not have to use their own money unless the plan makes them financially responsible. It does not add new liability for entities that are not on the hook under the plan. Administrators keep their right to seek repayment from the party that is ultimately liable.
