Small businesses cannot sell THC hemp edibles

Montana businesses cannot sell edible products that contain a hemp product with total delta-9 THC to consumers. Sales are allowed only if the item is authorized by the U.S. Food and Drug Administration as a food or drug. The rule applies only to edible products; it does not cover smoking or vaping items. A consumer is someone who takes the product and does not resell it. Synthetic cannabinoids are not considered hemp. The law takes effect on passage and approval.
