State funds felony enforcement on Flathead Reservation

The law sets up state reimbursements for costs to enforce felony laws on the Flathead Reservation. The Office of Budget and Program Planning runs the payments. It provides $6 million from the general fund for the two-year period starting July 1, 2025.

Payments to Lake County and Tribes with conditions

By July 31, 2025, the state pays $250,000 to Lake County and $250,000 to the Confederated Salish and Kootenai Tribes if Lake County rescinds Resolution 22-42(a) adopted January 3, 2023. If that happens, Lake County cannot withdraw consent to enforce criminal jurisdiction again until the later of June 1, 2027, or June 30, 2028 if the 2021 termination date is extended past June 30, 2027. After the state, Lake County, and the Tribes sign a Public Law 280 cost‑sharing agreement, the rest of the FY 2025 money is split equally within 30 days. The agreement must cover how to spend funds for FY 2025 and FY 2026. For FY 2026, equal payments go out by July 31, 2026, once the budget office confirms everyone is substantially following the agreement.
