Brokers and salespeople can manage property

A real estate broker licensed under Title 37, chapter 51 can act as a property manager. A licensed salesperson can manage property only with a supervising broker. No separate property manager license is needed for these licensees. The law is in effect now.

More people exempt from property manager licenses

The law expands who does not need a property manager license. You are exempt if you own the entity that owns the property. You are also exempt if you own an entity that manages the property for a family-owned entity, but all owners of both entities must be relatives of the owner or the owner’s spouse. A spouse and close relatives (child, descendant of a child, sibling, parent, niece, nephew, aunt, or uncle) are exempt. You are exempt if you lease no more than four residential units. You are exempt when acting as attorney-in-fact under a power of attorney, as an attorney at law doing legal work, as a trustee or under a court order, or as a state or local officer on duty. You are exempt if you receive reduced rent or salary, unless you can sign on the trust account. Employees are exempt when management duties are only a small part of their other job duties. Managers of state-licensed lodging establishments are exempt. A person employed on a salaried basis by only one person is also exempt. For these ownership exemptions, “owner” means a sole proprietor, an LLC managing member, a corporate shareholder, or a partner. The law is in effect now.
