Easy renewals and public access

If nothing has changed since the last filing, a filer may sign a certification instead of submitting a full statement. The Commissioner of Political Practices provides the certification form. The Commissioner must give any person copies of filed disclosures and certifications on request.

Officials and candidates must file first

State officers, holdover senators, supreme court justices, and district court judges must file a business disclosure by December 15 of every even-numbered year. Candidates for statewide or district state offices must file within 5 days after they file for office. Appointees must file when their name is sent for confirmation or when they take office, whichever comes first. No one may assume or continue the duties of the office until the statement is filed. If a person filed as a candidate or appointee during the same period, the December filing is not required that year.

What officials must disclose financially

The disclosure must list the person's name, address, and type of business. It must list any current benefit-paying employers, including retirement. It must list each business or trust owned over 10%, or over 1% if it is publicly traded, and any entity where the person is an officer or director. It must list real property (not the personal residence) owned over 10%; property can be described generally. Mutual fund holdings do not need to be listed.
