Limits on board reporting for wellness

No one has to report you to your licensing board just because you join a qualifying wellness program. Reporting is still allowed if someone, acting reasonably and in good faith, believes you are not competent to keep practicing or are a danger to yourself, patients, or the public. Physician and dental reporting laws now follow these wellness privacy rules. Reporting for issues outside the program stays the same.

Wellness program records kept confidential

The law keeps records and notes from qualifying wellness programs private. They are not allowed in civil lawsuits unless a judge, after a private review, finds the proof is not available elsewhere and that extraordinary need outweighs privacy. In licensing cases, an administrative judge can order limited disclosure only after a private review and only if public safety outweighs the person’s privacy. This encourages providers to seek help without fear their program files will be used against them.

Who is covered by wellness protections

The law explains which programs and people get these protections. A qualifying program must focus on career fatigue and wellness, be created or contracted by a statewide health provider association, and be tax‑exempt under 501(c)(3) or 501(c)(6). Covered providers include doctors, nurses, dentists, pharmacists, mental and behavioral health workers, and similar licensed professionals. Students in medical and health training programs are covered too.

Immunity and conflict rules for programs

People who review or advise a qualifying wellness program are protected from civil lawsuits for actions taken in that role. At the same time, an active program participant cannot work for the program or own any part of it. The law builds trust in these programs while preventing conflicts of interest.
