Bill Overview

Analyzed Economic Effects

4 provisions identified: 1 benefits, 1 costs, 2 mixed.

Gambling fines fund state Justice Department

All fines and penalties from gambling violations go to the state Department of Justice operating budget. Agencies that collect these fines must send the money there. This supports enforcement and oversight of gambling laws.

Tougher penalties for illegal gambling

If someone purposely commits a felony gambling violation, the law allows a fine up to $50,000 and up to 10 years in prison per violation. The department must revoke all gambling licenses and permits for the person and may not issue new ones. It is also a misdemeanor to advertise for or ask someone to join illegal gambling or use an illegal device.

Clearer definitions for gambling devices and businesses

The law defines an antique gambling device as made before 1994 or at least 30 years old. It also defines what counts as an illegal gambling business, including internet gambling that is not authorized. These updates guide dealers, operators, and regulators and help separate legal play from illegal enterprises.

Online casinos using money are illegal

The law bans online casinos that accept any money, including cryptocurrency. Sites that do not allow any money are allowed. Licensed activities and tribal gaming under federal law are excluded. Running an illegal internet gambling site in the state, even through offshore sources, is a felony and the law’s felony penalties apply.
