The Department of Transportation can restrict commercial automated vehicles during dangerous or forecasted road conditions. Manufacturers or operators can get an exemption if they demonstrate safe performance in those conditions. Fleets may need to pause, slow, or reroute service during storms.
The law defines key terms like automated driving system, levels 1–5, dynamic driving task, and fallback ready user. The Department of Justice and the Department of Transportation can write rules for automated vehicles. Before proposing rules, they must consult the transportation interim committee, law enforcement, insurers, drivers, pedestrians, and tribal and local governments.
The law lets cars with level 1, 2, or 3 automation run on Montana roads. Level 4 or 5 vehicles can operate where the Department of Transportation's rules allow. Cities and counties may set traffic rules, but they cannot single out automated vehicles.
