Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 0 costs, 2 mixed.

Small Garner claims settled up to $10,000

The town manager can settle personal injury or property damage claims against the Town of Garner for $10,000 or less. The payment cannot be more than your actual loss, like lost time, medical bills, and other real costs. The town manager can also settle debts you owe the town for $10,000 or less. The town council must authorize the manager to use this power.

Eminent domain deals tied to project budget

If your property is taken for a town project, the town manager can settle your claim. The town council must first allow the manager to use this power. The settlement cannot be more than the amount budgeted to buy the property or easement for the approved project. This can speed payment, but it may limit how much you receive.

Rules and finality for town settlements

Any settlement by the town manager must be approved by the town attorney. The town manager must report these settlements to the town council. After you accept a settlement under this law, you cannot seek more money from the town for the same claim.
