Protections for parents on biological sex

Beginning July 1, 2025, parents and other caregivers are not guilty of misdemeanor or felony child abuse just for raising or referring to a child based on the child’s biological sex, or for related medical or mental-health choices. Courts also do not treat this as “serious mental injury” for felony child abuse. Beginning July 3, 2025, child welfare cannot base an abuse or neglect petition only on sex-consistent parenting or how you refer to the child. Other abuse or neglect—like causing serious physical injury or a clear risk of harm—remains illegal.

No adoption denials for race or gender transition

Beginning July 3, 2025, adoption agencies cannot deny or delay your chance to become an adoptive parent, or a child’s placement, because of race, color, or national origin. They also cannot deny or delay you because you refuse or do not support a child’s gender transition. This applies when agencies take custody and make adoptive placements.
