The law defines IEP "nursing services." Only nurses licensed under Article 9A of Chapter 90 may provide this care. This clarifies who can legally deliver IEP nursing services. Beginning July 1, 2025, for the 2025–26 school year, schools must use licensed nurses for IEP nursing.
Beginning July 1, 2025, schools must assign the parent's chosen nurse for IEP nursing if four rules are met. The child must have received care from that nurse before the IEP required nursing or before enrolling at the current school. The nurse must work for a nursing agency and be willing to provide the services. The agency must accept the school’s standard contract, including licensing and liability terms. The agency’s rate must be equal to or lower than what the school pays other contracted nurses. This applies starting with the 2025–26 school year.
Local school districts can contract with private special education facilities or providers. They do this when the district cannot furnish a needed special education or related service. This helps families get services the school cannot provide on its own. The rule begins July 1, 2025, for the 2025–26 school year.
