Patient protections when provider contracts end

New Hampshire requires continued-access protections in insurer contracts with physicians or facilities entered after July 1, 2003. When a contract ends for reasons other than unprofessional behavior, affected patients keep access for 60 days from termination. Care is provided and paid for under the patient's health plan and the prior provider contract. Within 5 business days after termination, the insurer and provider must jointly send written notice explaining access rights and hearing plans. For terminations affecting at least 1,000 covered people, the insurance commissioner must hold a public hearing within 15 business days after receiving notice. Insurers, providers, and the public can give testimony, including about access to quality, affordable physical and mental health care. The law takes effect 60 days after passage, and the contract changes apply going forward, not retroactively.
