New care insurance options and consumer rules
Effective 60 days after passage, the law lets New Hampshire’s Insurance Commissioner approve innovative short-term or long-term care policies, certificates, and rates. Offering them must not conflict with the public’s best interests, and benefits must be reasonable for the premium charged. The law requires rules for clear, complete long-term care insurance disclosures, including eligibility, renewals, dependent coverage, preexisting conditions, and duplicate coverage. Required disclosure rules also cover waiting periods, coverage limits and exclusions, recurring conditions, ending or continuing coverage, conversions, replacements, and definitions. Rulemaking authority also covers claim-payment standards, insurer filings, agent pay and testing, penalties, and reporting.
Stronger review of insurance policies and rates
Effective 60 days after passage, New Hampshire’s Insurance Commissioner can reject filed long-term care insurance forms within 30 days. Grounds include benefits unreasonable for the premium, unfair or misleading terms or rate increases, encouraged misrepresentation, and violations of law or rules. Review can take longer when more information is needed or a hearing is planned. After a noncompliance notice, insurers cannot issue or use the form; notices must explain why and promise a hearing within 20 days of a written request. The commissioner can also hold public hearings before deciding any insurance form or rate filing and disclose information needed for the hearing.
