Retailers face hemp THC ban and fines
Starting January 1, 2027, licensed premises must follow the hemp THC ban and keep locations from being used to break the law. Selling a prohibited hemp product brings a $100 fine for a first offense. Repeat offenses are a class B misdemeanor with a $300 to $1,200 fine, and the product is seized. Corporations and associations can be fined up to $20,000 for a misdemeanor and up to $1,000 for a violation, and courts can force payment.
New hemp THC limits and under 21 ban
Starting January 1, 2027, New Hampshire bans sales of hemp products with more than 0.3% THC by dry weight. The ban covers all THC types, including delta-8 and delta-9. People under 21 cannot buy, have, or use any hemp product that contains any THC. Knowingly having a banned product is a violation the first time and a class B misdemeanor after that.
