Hazardous waste operators face permit denial

New Hampshire’s Department of Environmental Services may deny hazardous waste permits when applicants lack reliability, expertise, integrity, or competence. It may also deny permits based on felony convictions or guilty or no-contest pleas in state or federal court. That rule covers applicants and specified related people during the five years before the application. Denial is allowed, not automatic.

Waste operators face checks and review costs

Solid and hazardous waste permit applicants and covered business leaders must provide operating histories and complete state and fingerprint-based national checks. These rules cover permit transfers, solid waste permit changes, and changes in ownership of solid waste permit holders. Hazardous waste applicants must name owners, directors, officers, partners, members, managers, or participants, depending on their business type. New Hampshire’s Department of Environmental Services may charge applicants for reviews and checks; no fee amount is set. Government bodies and municipalities are exempt from criminal checks, and department rules may exempt some application types from both reviews. Criminal records must remain confidential and be destroyed within 60 days after the final decision or any appeal ends, whichever is later.
