The law applies beginning with the first full school year after October 4, 2024. New Jersey school boards, nonpublic school governing bodies, and State agencies can approve certified mobility-assistance vehicle technicians to transport students. Eligible school-aged children must have a life-threatening medical condition requiring more individualized and continuous care. Trips in mobility-assistance vehicles can cover travel to and from school or related school activities. Technicians are exempt from school bus driver licensing and regulation. These trips are exempt from school-bus registration, equipment, inspection, and maintenance rules. Before transporting students each year, technicians must give the Executive County Superintendent a criminal background check and evidence of a check for alcohol- or drug-related driving violations.
