Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 1 costs, 2 mixed.

Public access to data oversight is limited

Information shared, sent, or received to carry out this law is excluded from government-record access under state law and common law. This includes information shared under the Motor Vehicle Commission provision, not all government records. The data system’s governing body is also exempt from New Jersey’s Open Public Meetings Act. That act’s public-meeting requirements do not apply to the body.

Driver data sharing expands with privacy limits

After a signed agreement, the Motor Vehicle Commission must share specified personal data with the education and workforce data system. Sharing must follow federal driver-privacy law and the agreement. This sharing excludes photos, noncitizen-status information, Social Security numbers beyond the last four digits, and specified information about people without Social Security numbers or using taxpayer identification numbers. Separate provisions allow disclosure of Social Security or Individual Taxpayer Identification Numbers only to check the system’s data accuracy. These provisions cover standard basic and motorcycle licenses, standard permits, learner permits, and probationary licenses. Other standard-credential applicant information can also be shared under the system’s rules, but photos remain excluded. Beginning January 20, 2026, the limited number-disclosure authority also covers identification-card applicants.

New Jersey links education and job records

The law creates a governing body in New Jersey’s Department of Education to link education, training, employment, and earnings data. The body can run the system or hire an outside operator to study programs and guide policy. Participating state agencies must provide needed data but keep control of their records. The system must meet National Institute of Standards and Technology security standards, maintain applicable certifications, and follow data-protection laws. Only combined, group-level data can leave its secure environment.
