Safer passing rules and fines for drivers

Beginning May 2, 2024, New Jersey drivers must use caution when passing people in designated walking, bicycle, or personal conveyance areas. Protected users include people walking and people outside vehicles for work, emergency response, or recreation. They also include people using bicycles, wheelchairs, electric bikes, scooters, skateboards, skates, and other transportation devices. Unless law enforcement directs otherwise, drivers must move to a lane not next to the person when possible. If changing lanes is not possible, drivers must leave at least four feet while approaching and until safely past. If neither option is possible, legal, or safe, drivers must slow to 25 miles per hour or the lower posted limit. They must be ready to stop and pass only without endangering the person. Drivers must consider vehicle size and speed, traffic, weather, visibility, and road width and surface. Violations without bodily injury carry a $100 fine and no motor vehicle penalty points. Violations causing bodily injury carry a $500 fine and two points. Drivers can still face prosecution for other offenses.
