Bill Overview

Analyzed Economic Effects

10 provisions identified: 4 benefits, 0 costs, 6 mixed.

More Grant Help for Kean Students

Eligible Kean students receive New Jersey Tuition Aid Grants at the higher public research university level. The state aid authority sets award amounts; the law does not state an individual increase. Beginning January 12, 2026, Kean is included in the Educational Opportunity Fund law without changing student eligibility rules. The New Jersey City University Foundation continues serving Hudson County residents attending Kean’s Jersey City campus. Foundation support does not guarantee an individual payment or award.

Faculty Keep Tenure but Lose Seniority

Transferred employees keep specified state pension, retirement, and health benefit protections. Former New Jersey City University faculty keep applicable tenure rights and academic rank, but not their former university seniority. Faculty tenured under section 2 of P.L.2013, c.235 must be hired by Kean with tenure. Those faculty do not count toward limits on new full-time tenure-track hires.

Transferred Workers Face New Employment Terms

After merger approvals, transferred New Jersey City University workers follow Kean’s rules, and their existing university employment contracts and labor agreements end. Represented workers join the Kean bargaining unit covering their title and receive its contract terms. When no unit covers a title, Kean or worker representatives can seek a state labor commission ruling. Civil Service status stays unchanged, but covered workers face a working test period unless Kean waives it. Kean can reorganize, privatize services, or lay off workers, subject to applicable Civil Service rules, labor agreements, and good-faith consultation with worker representatives.

Kean Workers Keep Rights and Representation

Beginning January 12, 2026, employees who worked at Kean when P.L.2021, c.282 took effect are not treated as new hires. They keep accrued seniority, rank, tenure, specified benefits, and existing representation and labor agreements. Also beginning that date, employees joining Kean through mergers become public employees with applicable statewide bargaining-unit representation. That rule excludes employees of subsidiaries expressly formed under subsection x of section 9 of P.L.2021, c.282.

Kean Opens Records and Shields Officials

Beginning January 12, 2026, Kean must maintain and regularly update a public board website with rules, policies, and meeting minutes. Meeting notices must appear at least five business days before meetings. The website must also describe contracts awarded without competitive bids and identify their legal authority. Beginning the same date, trustees and officers are not personally liable for university debts and covered liabilities of university units and affiliates.

Kean Merger Gets Campuses and Funding

The law authorizes Kean to merge with New Jersey City University after completing their October 1, 2025 agreement requirements. Kean’s president must notify the state higher education secretary that those requirements are complete. After required approvals, Kean receives the university’s campuses, operations, funds, and all state-funded positions from the fiscal year 2026 budget. Property must serve public higher education, and transferred funds keep their existing use restrictions. Beginning January 12, 2026, Kean receives $25 million to carry out the law, while its existing resources transfer with legal restrictions intact.

Kean Can Offer Fee-Based Teacher Training

Kean can offer summer and extension courses for further training of New Jersey public-school teachers. It can charge course fees, but the law sets no amounts or required course offerings. Kean’s board can also maintain demonstration schools with regular teachers for observing and practicing approved teaching methods. The law sets no school count or guaranteed place.

Kean Gains Merger and Property Powers

Kean can merge with qualifying tax-exempt educational nonprofits or New Jersey public colleges when consistent with their public purposes. Kean takes on specified rights and debts; mergers with qualifying Kean-created subsidiaries formed after this law’s effective date need no Attorney General approval. Beginning January 12, 2026, Kean’s board controls and holds title to property from qualifying mergers occurring on or after this law’s effective date. State oversight remains, and Educational Facilities Authority property transfers must follow special legal requirements. Also beginning January 12, 2026, the law repeals sections 1–3 of P.L.2000, c.41; the supplied text does not explain their effects.

Kean Gets Purchasing Options and Bid Rules

Kean must publicly advertise and competitively bid covered contracts above $42,600 when workers receive prevailing wages, or $100,000 otherwise. Exceptions include specified public-utility contracts, urgent needs, and emergencies. Beginning July 1, 2027, the Governor adjusts both limits every two years using consumer price changes around New York City and Philadelphia. Beginning January 12, 2026, Kean can also use state joint-purchasing systems and nationally recognized purchasing agreements.

Kean Takes Debt With State Help

Once the merger takes effect and required approvals arrive, New Jersey City University’s debts transfer to Kean. Creditors can enforce those debts against Kean just as they could against the former university. Kean can refinance, restructure, or change repayment terms. The State must help reduce debt outstanding at merger that was issued by the Educational Facilities Authority or Economic Development Authority. The law sets no amount for that help.
