New Mexico’s Mi Via program provides self-directed Medicaid home- and community-based services. Providers’ gross receipts taxes cannot count toward or reduce participants’ approved annual budgets for services, supports, and goods. Providers must bill participants or payers for these taxes as a separate line item. These costs are reimbursed in addition to the approved budget. The Health Care Authority must issue rules to enforce this budget protection.
