New Mexico's insurance superintendent must set a standard process for checking dentists' and dental hygienists' qualifications for insurance networks. The process covers first applications and renewals, using no more than two approved forms. Insurers cannot require information beyond those forms or verify primary credentials more often than every three years. Within 10 working days of receiving an application, insurers must request needed information through a signed notice by certified mail. The notice must list everything needed and provide a contact. Applicants must receive verification and a written decision within 30 calendar days after a complete application arrives. Insurers can take up to 15 extra calendar days for issues such as sanctions, investigations, felony convictions, or denied insurance coverage. Approved providers must enter payment systems and provider directories within the applicable 30- or 45-calendar-day period. Rules must allow provisional approval for up to one year, but insurers do not have to accept any applicant.
New Mexico insurers must pay qualifying dentists and dental hygienists for covered claims submitted more than 30 calendar days after receiving a complete network application. Providers must submit required documents on time and have no reported past or current license sanctions or limits. They must also have professional liability insurance or coverage under New Mexico's Medical Malpractice Act. Payment protections apply when an insurer approves the application, misses its decision deadline, or fails to enter approved information into its payment system on time. Providers employed by a practice with an insurer contract receive the contract rate; others receive the insurer's standard rate. The payment obligation ends at approval or denial, or three years after receipt of the complete application, whichever comes first. The insurance superintendent must set rules for payment and application disputes when the process takes more than 30 days.
