Lower behavioral health costs for insured patients

Beginning January 1, 2026, covered New Mexico health plans offering behavioral health services cannot charge copays, coinsurance, deductibles, or other cost sharing for that care. Premiums still apply. The rule covers in-network care under public purchasing plans, group or blanket coverage, health maintenance organizations, and health care plans. The separate individual/group insurance provision has no stated network limit. Covered services include treatment, prevention, identification, and skill-building for mental illness, substance use disorders, and trauma-related disorders. Care includes hospital stays, detox, residential treatment, partial hospitalization, intensive outpatient care, outpatient therapy, and medications—including brand-name drugs when generics are unavailable. Excepted-benefit and catastrophic plans are excluded. High-deductible plans with health savings accounts are exempt until the deductible is met, unless federal law allows otherwise.
