More donated medicine options for patients

New Mexico allows anyone, including out-of-state donors, to donate unused, unexpired prescription drugs. Licensed drug distributors, licensed health care facilities, and prescribing practitioners can receive donations after registering with the board. Board rules must allow experienced, qualifying pharmacies inside and outside New Mexico to serve patients in person or by mail. Rules must also cover refrigerated drugs, but controlled substances are excluded. Donors must confirm proper storage, intact containers, drug quality, and voluntary donation. Recipients must follow storage, labeling, and distribution rules, check for tampering, and inspect drugs for safety before dispensing. They must also certify storage followed the label. Drugs cannot expire before patients finish using them as prescribed. The board must publish a current list of registered recipients and require a patient acknowledgment form. People who use reasonable care in donating, accepting, or redistributing drugs receive protection from civil liability, criminal liability, and professional discipline. The form must explain these protections and the donor care and inspection steps. Existing manufacturer, distributor, and dispenser liability otherwise remains, except manufacturers are not liable for failing to pass along consumer information or expiration dates. Government agencies keep their authority to regulate or ban drugs.

Patients can pay medicine handling fees

Patients receiving donated prescription drugs can be charged a handling fee by the registered recipient. The fee cannot exceed reasonable collection costs, including checking, storing, labeling, and distributing the drugs. The law sets no fixed dollar fee.
