Analyzed Economic Effects

2 provisions identified: 2 benefits, 0 costs, 0 mixed.

Stronger privacy for residents' sensitive state records

Beginning July 1, 2025, New Mexico state agency workers cannot intentionally share sensitive information learned through their jobs outside their agency. Protected details include public-assistance and crime-victim status, sexual orientation, gender identity, physical or mental disability, medical condition, immigration status, national origin, and religion. Social Security numbers and individual taxpayer identification numbers are also protected. Exceptions allow sharing for agency work, court orders or subpoenas, public-records or federal-law requirements, and judicial or administrative proceedings. Other exceptions cover protected whistleblower reports, disclosures allowed by federal health privacy law, and the person's written consent. Contractors needing the information for their work must agree in writing to the same sharing limits. The attorney general, district attorneys, or state ethics commission can bring district court cases to prevent or address violations. Civil penalties are $250 per violation, capped at $5,000 total.

Immigrants gain motor vehicle record protections

Beginning July 1, 2025, New Mexico motor vehicle agencies cannot share covered personal records for federal immigration-law enforcement. This limit applies to current and former agency workers and contractors sharing with government agencies or outside groups. Covered records concern driver's licenses and permits, vehicle titles and registrations, ignition interlock licensing and fund administration, and state identification cards. Sharing for enforcement of the federal immigration law's felony criminal provisions remains allowed. Outside groups receiving records under agency contracts must certify in writing that they will follow this immigration-use limit. Certification is required before access and again when agreements renew. The Motor Vehicle Division director can revoke access after finding a violation.
