New Mexico municipalities can create utilities by ordinance to collect, treat, store or dispose of stormwater, but are not required to. They can charge people who own or control property just and reasonable service fees, with no amount set by this law. Municipalities and other entities covered by the law can also require reasonable advance payments or deposits for stormwater service. Charges unpaid within 30 days after their due date can lead to water or other listed services being shut off. Those services cannot resume until overdue charges, interest and penalties are fully paid.
