AN ACT relating to water; requiring the State Engineer to retire certain groundwater rights; revising provisions relating to temporary permits to appropriate groundwater; creating the Nevada Conservation and Recreation Program; creating the Account for Retiring Water Rights; establishing the Nevada Voluntary Water Rights Retirement Program; requiring the Director of the State Department of Conservation and Natural Resources to purchase certain water rights with money from the Account for the purpose of retiring those water rights; revising provisions relating to the program to provide grants of money to pay certain costs related to water conservation and capital improvements to water systems; revising provisions relating to a program to pay the costs for property owners to connect to a community sewerage disposal system under certain circumstances; revising certain legislative declarations relating to clean water and water pollution; authorizing the State Environmental Commission to establish a water quality standard variance; revising provisions relating to an irrigation water efficiency monitoring program established by the Southern Nevada Water Authority; revising provisions relating to membership on the Advisory Committee for the Management of Groundwater in the Las Vegas Valley Groundwater Basin; and providing other matters properly relating thereto.

100% help to abandon septic

Beginning July 1, 2025, a health district may offer a voluntary program that pays 100% to abandon a septic system and connect to sewer. You must have a septic system on a property served by municipal water and pay the district’s voluntary annual fee (or catch up on past fees). The annual fee cannot be higher than the largest sewer system’s annual rate in the county.

Stricter well rules with connection help

Starting July 1, 2025, the State Engineer issues revocable groundwater permits only when no public water provider can serve. A permit can be revoked if public water is within 1,250 feet, and you then have 730 days to connect. The State Engineer records a notice that a revocable permit can be revoked, repairs may be barred, and you may have to pay to connect. Any valid temporary permit issued before July 1, 2025 becomes a revocable permit. If you are required to connect, the Southern Nevada Water Authority pays 50%–85% of connection fees and needed capital costs, and pays to abandon or plug wells.

Buy and retire groundwater rights by 2035

Beginning July 1, 2025, Nevada runs a program to buy or accept donations of decreed or certificated groundwater rights and retire them forever. The Director may approve purchases from willing sellers or donations only through June 30, 2035. The State Engineer retires approved rights in the source in perpetuity, and applications to change or reinstate retired rights are rejected. A state Account funds purchases, matching money, and administration, and it can take grants and federal funds. Grants can also pay to permanently retire rights to protect resources and address falling groundwater.

Water reuse and recreation rules change

Beginning July 1, 2025, Nevada encourages water reuse, including return‑flow credits and direct or indirect potable reuse, with public‑health protections. Recreational use of water is a recognized beneficial use. In counties with 700,000+ people, local governments may restrict recreational uses in man‑made lakes or streams, with listed exceptions. The State Environmental Commission may issue time‑limited water‑quality variances that meet federal rules and reflect the highest attainable condition.

Water system grants and turf removal

Starting July 1, 2025, grants can fund removing grass and installing water‑efficient landscaping if protected by a conservation easement. Grants for public water systems are limited to the Lincoln County Water District and public systems that existed on January 1, 1995; systems serving under 6,000 people get preference. Each recipient must pay 15%–75% of project costs, set by local median income and adjusted for hardship or urgent health risks.

Monitoring for large turf irrigation

Starting July 1, 2025, the Southern Nevada Water Authority requires owners of non‑single‑family parcels with 20,000 square feet or more of turf to join an irrigation efficiency monitoring program. The board sets policies and deadlines and must give at least one year’s notice. The general manager may grant extensions or waivers.
