Criminal penalties for threatening candidates

The law makes it a crime to threaten or intimidate a candidate for public office. It covers threats to the candidate, their family, or their property. A first offense is a misdemeanor. A second or later offense is a gross misdemeanor. The law does not punish constitutionally protected speech, including political hyperbole.

Report threats to Secretary of State

If you are a candidate and believe you were threatened, you can send a written notice to the Nevada Secretary of State. The Secretary must investigate. If there is reasonable suspicion of a violation, the Secretary must refer the case to the Attorney General to decide on court action. After the investigation, the Secretary must give you a written report with findings and any referral result.
