Storage sale proceeds without renter opposition

If the renter’s written declaration opposing the lien sale is not received by the sale date stated in the mailed notice, the owner may go ahead with the sale. Missing the deadline risks losing the stored items.

New ad and notice rules for storage sales

Owners must place at least one ad in the week before the sale in a local newspaper. The ad must show the renter’s name, the storage unit number, and the facility’s name and address. It no longer needs a general description of the items. If no local newspaper exists, the owner must post the notice at least 10 days before the sale in six nearby public places or on a public website.

Protections and excess money after storage sale

Lien sales must be commercially reasonable. After deducting the lien and sale costs, the owner must keep any extra money for the renter. The renter or an authorized person can claim the money within 1 year of the sale. After 1 year, the owner must send any unclaimed money to the county treasurer for the county general fund.
