AN ACT relating to the criminal justice system; prohibiting a person from threatening or intimidating any judicial personnel of an Indian tribe; expanding the applicability of enhanced penalties for assault and battery against certain persons; authorizing any judicial personnel of an Indian tribe to request a court order to maintain certain personal information in the possession of a county recorder, a county assessor or an elections official in a confidential manner; authorizing any judicial personnel of an Indian tribe to request the Department of Motor Vehicles to display an alternate address on the driver's license, commercial driver's license or identification card of the judicial personnel; providing penalties; and providing other matters properly relating thereto.

Privacy protections for tribal court staff

Tribal judicial personnel can ask a county assessor to keep their personal information confidential by following NRS 250.140. They can also ask the Secretary of State or a city or county clerk to keep certain records private under NRS 293.908. They may ask the DMV to show an alternate address on a driver’s license or ID, with proof of status and home and mailing addresses if different. These tools help keep home locations and contact details out of public records.

Tougher penalties for attacks on tribal court staff

It is a crime to threaten or intimidate tribal judicial personnel to influence their duties. If you use or threaten physical force, a first offense is a category C felony; later offenses are a category B felony with 2 to 10 years in prison and up to a $10,000 fine. If no physical force is used, it is a gross misdemeanor. Assaults on tribal judicial personnel while they are working or at their workplace now carry higher penalties, and using a deadly weapon or being in custody can make it a felony. The offender must know or should know the victim is tribal judicial personnel.
