If the Commission declares an emergency in an area with relief and no alternative voice service, it can act to protect health and safety. It may use the fund to keep phone service available and may order a provider to help, but only to the extent that provider gets fund money under the order. If a home lost phone access because relief was approved, the resident may file a request for service on or before 2016-05-31. The Commission investigates and may order the relieved supplier to provide service for a set time, including by offering an approved alternative voice service.
A carrier that is released from last-resort duties cannot get money from the state fund to maintain service in that area. It can still get fund support only for Lifeline service under NRS 707.450.
The law makes it easier for a carrier to leave last-resort phone duties when enough other providers serve the area. Relief is allowed when the area has either: at least one non‑affiliate wireline provider and one other provider for the whole area; on or after 2015-06-01, two or more wireless or satellite providers for the whole area; or on or after 2015-06-01, three or more providers using any technology for the whole area. Satellite voice now counts as alternative voice service if it reaches the public network and 911. State approval does not change any federal duties of incumbent carriers. Other providers do not automatically take on last-resort duties. Incumbent carriers that got relief by 2013-06-02 are treated as fully released for that area.
An application must include a street‑level map of the full area and list each alternative provider the carrier relies on. The Commission must approve or deny the request within 180 days. Within 30 days of filing, the carrier must give written notice to every current customer and each 911 answering point in the area. The notice must say relief is sought in the customer’s area and that a consumer session will be held. The carrier must meet with the Commission, the Consumer’s Advocate, 911 centers, and local police. Within 120 days of filing, the Commission must hold at least one consumer session in each county in the area and give public notice.
