AN ACT relating to health care; prohibiting certain governmental entities from substantially burdening certain activity relating to contraception and family planning services under certain circumstances; authorizing a person whose engagement in such activity has been so burdened to assert the violation as a claim or defense in a judicial proceeding; authorizing a court to award damages against a governmental entity that substantially burdens such activity in certain circumstances; and providing other matters properly relating thereto.

Stronger protections for birth control access

Beginning January 1, 2026, state and local governments cannot single out birth control or family planning care. They cannot impose limits that substantially block access or a provider’s ability to give care within their scope. Any limit must be proven by clear and convincing evidence, serve a compelling interest, and be the least restrictive way. These protections apply to all state and local laws and how they are carried out, old or new. No one can be sterilized without voluntary, informed consent.

Right to sue over blocked contraception

Beginning January 1, 2026, you or your health provider can sue or raise a defense if this law is violated. Courts award court costs and attorney fees to you if you win. You may also get damages from a government agency, but Nevada’s damages cap in NRS 41.035 can apply.

Abortion and school policies not covered

Beginning January 1, 2026, this act does not cover laws about abortion, abortion drugs, or services tied to abortion. It also does not cover policies by state or local education authorities made on or after that date. Activities at or sponsored by public schools are also excluded. Other laws govern those areas.

Courts can block frivolous contraception suits

Beginning January 1, 2026, courts can label people who file meritless or harassing contraception claims as vexatious litigants. A court may then block them from bringing more claims under this act.
