Fines and enforcement for balloon releases

Violations carry a civil penalty of up to $250 for each release. The Attorney General or local prosecutors must sue in civil court to collect penalties and can ask a court to stop ongoing or likely violations. Money the Attorney General collects goes to the State General Fund. Money local prosecutors collect goes to their county or city treasury.

Ban on releasing lighter-than-air balloons

The law bans anyone from intentionally releasing a balloon filled with a gas lighter than air. It covers balloons made of non-biodegradable material, and those that take more than 5 minutes in air or water to break down. The ban does not cover hot air balloons that are recovered after launch. It also does not cover balloons used for government or scientific research, or balloons released that stay indoors.
