Right to sue over donor leaks

Beginning July 1, 2027, you can sue if a government agency, officer, or employee harms you by violating these donor, member, or volunteer privacy rules. You must show they caused harm and knew or should have known they were breaking the law. You can get an injunction, your costs and reasonable attorney’s fees, and statutory damages: $1,000 for a first offense, $5,000 for a second, and $10,000 for a third or later offense. A court can triple the damages if the conduct was reckless or willful.

Keep nonprofit donors and members private

Beginning July 1, 2027, Nevada government agencies must keep private any data that names you as a donor, member, or volunteer of a nonprofit. Agencies cannot ask for or release donor, member, or volunteer lists, and cannot make contractors or grantees hand over the nonprofits they support. The Secretary of State, when handling Title 7 duties, cannot collect or disclose information that directly identifies you as a donor. The Attorney General may use charity information only for a specific audit or case, and it stays confidential unless another law requires it to be public. The law lists limited exceptions, such as federal requirements, valid warrants or court orders, certain regulatory filings and licensing checks named in the statute, and voluntary or court‑authorized disclosures.
