AN ACT relating to trade regulations; setting forth certain requirements and restrictions concerning certain inflatable devices; requiring certain businesses that operate such devices to meet certain requirements; setting forth requirements for certain inspections of and warnings relating to such devices; imposing certain restrictions on the use of such devices under certain circumstances; authorizing a county, city or town to enact certain ordinances; and providing other matters properly relating thereto.

Licenses and $1 million liability for inflatable businesses

Beginning January 1, 2026, inflatable-device operator businesses in Nevada must hold all required state and local business licenses. They must also carry at least $1,000,000 in liability insurance, a certificate of insurance, or a surety bond before operating. Operating without these is not allowed.

Inflatable operators: safety checks and records

Beginning January 1, 2026, operators must inspect each inflatable and the site before any use. Follow the maker’s manual, updates, and any recall notices. Do not allow use if the inspection shows a hazard. Keep a logbook with the device, record each inspection, and keep records at least 2 years. Post an "OPERATOR'S WARNING" sign in red, at least 2 feet by 2 feet, in 72-point bold type, with the required safety details.

Inflatables: keep labels or destroy device

Beginning January 1, 2026, all original manufacturer labels on each inflatable must be attached and readable before use. If any label is missing or unreadable, you must stop using the device and destroy it. You also may not sell or transfer a device unless all labels are attached and readable and you give the buyer the user manual, updates, and any recall information.

Wind limits and anchoring rules for inflatables

Beginning January 1, 2026, do not operate an inflatable when wind is over the maker’s limit or 15 miles per hour, whichever is higher. Measure and record wind with an anemometer before use, watch it during use, and stop and deflate if wind goes over. Anchor the device at all times. Use noncorrosive metal stakes at least 18 inches long driven at a 22-degree angle toward the center, or use weights of at least 75 pounds per anchor point (or more if the maker requires).

Local rules and penalties for operators

Beginning January 1, 2026, any Nevada county, city, or town may set the same or stricter rules for inflatable-device operators. Local ordinances may include civil or criminal penalties. Local governments may use part of business license fees to pay for enforcement of these local rules.
