AN ACT relating to insurance; revising the manner in which a data request or report submitted to the Commissioner of Insurance by certain insurers or other organizations providing health coverage relating to the compliance of the insurer or organization with certain federal laws must be submitted to the Commissioner; revising provisions governing the confidentiality of information contained in such a data request or report; and providing other matters properly relating thereto.

Stronger mental health parity for enrollees

Nevada-regulated health plans must follow the federal Mental Health Parity and Addiction Equity Act. This includes HMOs and Medicaid managed care plans. By July 1 each year, the Insurance Commissioner sends a standard data request. By October 1, plans must file it through SERFF or submit a federal report, and provide more information if asked. By December 31, the Commissioner sends a summary report to state leaders. The Commissioner can set rules to carry out and enforce these steps. These checks help find and fix unfair limits on mental health and addiction care.

More public access to parity data

Most data insurers send to the Commissioner is public. Your personal details stay private. True trade secrets stay private under Nevada’s legal definition. The Commissioner cannot hide data just because it shows compliance. When in doubt about trade secrets, the data must be public.
