AN ACT relating to housing; requiring the governing body of each county and city to adopt an ordinance to authorize by-right a multifamily housing development or mixed-use development that includes a residential use on property zoned for commercial use; declaring void certain county or city ordinances; authorizing the State Land Registrar to transfer, under certain circumstances, certain real property owned by the State of Nevada to certain entities without consideration; and providing other matters properly relating thereto.

By-right housing on commercial land statewide

The law requires every county and city to allow multifamily or mixed-use housing by right on commercial-zoned land. Local ordinances must be adopted not later than March 1, 2026, and can set objective standards. This does not apply to industrial zones, airport-related land, or land in the Tahoe Regional Planning Compact. Starting March 1, 2026, any local rule that conflicts with this law is void. Cities and counties can use tools like density bonuses, inclusionary zoning, and minimum density rules if they fit the master plan and design goals.

Free state land for Reno housing services

The State Land Registrar may give two parcels on the west side of the Northern Nevada Adult Mental Health Services Campus for free. About 4 acres go to Catholic Charities of Northern Nevada; about 1.3 acres go to Reno-Sparks Gospel Mission. The Reno Redevelopment Agency must sign required agreements, survey the land, prepare legal descriptions, and pay transfer costs. The deeds must limit use to community and social services, including affordable, workforce, or supportive housing and food and support services. The grantees cannot sell, lease, or mortgage the land without the Legislature’s OK; if they break the rules, the land returns to the State.

Faster court deadlines for land-use cases

If you ask a court to review a local land-use decision, you must file within 25 days of the notice. Serve your main brief within 40 days of filing; the other side has 30 days to answer; you have 30 days to reply. You may request a hearing within 7 days after your reply deadline. Briefs must meet appellate standards, and courts may extend deadlines for good cause.

Local costs to implement law exempted

Local governments’ extra costs to carry out this housing law are not subject to NRS 354.599. They can record and pay these expenses under other rules. This exemption only covers additional expenses related to this act.
