AN ACT relating to public health; requiring the Department of Health and Human Services to publish certain information relating to breastfeeding and develop a program of public education concerning lactation; authorizing certain providers of health care and medical facilities to provide that information to certain persons; prohibiting a place of public accommodation from engaging in certain discrimination against a person who is breastfeeding; authorizing certain civil actions and administrative actions to enforce that prohibition; and providing other matters properly relating thereto.

Breastfeeding rights and ways to enforce

Beginning 2025-07-01, businesses open to the public cannot deny you services because you are breastfeeding. They cannot post signs or statements that breastfeeding is unwelcome. You can file a complaint with the Nevada Equal Rights Commission. You can sue to recover actual damages, and courts can order other relief and award reasonable attorney’s fees and costs to the winner. The Commission can investigate and hold hearings. Cities and counties may pass local rules that match these protections.

Online-only businesses must follow access rules

Beginning 2025-07-01, websites, apps, and other online-only businesses that sell to the public in Nevada count as places of public accommodation. They must follow the same access and anti-discrimination rules as physical businesses. That includes protections for people who are breastfeeding.

Lactation info and support for parents

Beginning 2025-10-01, the state posts a Medicaid lactation fact sheet and a list of local lactation help with names, addresses, and phone numbers. The information is in English, Spanish, Tagalog, and other languages. The state also runs a public education program on lactation and how to get help. Doctors, physician assistants, advanced practice nurses, midwives, hospitals, and birth centers can share these materials with you and the people you choose.

Hair texture and styles protected

Beginning 2025-07-01, the law defines race to include hair texture and protective hairstyles. Examples include afros, bantu knots, curls, braids, locks, and twists. These traits are protected in anti-discrimination rules, including at work and in public places.

Private clubs and minor limits exempt

Beginning 2025-07-01, private clubs and small private online forums are not covered by public-accommodation rules. A private online forum must have no more than 1,000 members and not take regular payments from nonmembers. Businesses may enforce laws that bar minors from entering some premises or areas. This limits who can claim discrimination in those situations.
