AN ACT relating to health care; authorizing a patient in certain facilities or a resident of a living community for persons with disabilities or his or her representative to request the installation and use of an electronic communication device in the living quarters of the patient or the bedroom of the resident; prohibiting such a facility or living community or an employee of such a facility or living community from taking certain additional actions; prohibiting a provider of supported living arrangement services from taking certain actions with regard to the installation and use of an electronic communication device in the home of a recipient of such services; providing penalties; and providing other matters properly relating thereto.

Patients and residents can install devices

Starting October 1, 2025, patients in covered facilities and residents in disability living communities can ask to install an electronic communication device in their room. The facility must approve a complete request, including written consent from any roommate or the roommate’s representative. Devices must be able to be turned off, and video must avoid bathing, dressing, and toileting. The facility posts a clear sign at the bedroom door. Providers cannot ban devices in a person’s home or punish someone for asking or using a device. This does not apply to provider‑run residential settings. These rules cover nursing homes, assisted living, and other listed facilities and communities.

Tough penalties for device tampering

Starting October 1, 2025, no one may tamper with, destroy, or view or listen to device recordings without permission. Certain officials and people you authorize in writing may view them, and anyone who disables a device must turn it back on before leaving. A person can be fined up to $5,000 for a first offense and up to $10,000 per later violation, and may face a misdemeanor. A facility can be fined up to $10,000 for a first offense and up to $20,000 per later violation. Residents and authorized viewers may not post videos or audio of employees online; first time gets a notice, later violations can lead to paused services while the device is on or loss of device approval.

You pay for device and setup

Starting October 1, 2025, you or your representative must choose and pay for the device, installation, maintenance, repairs, and removal. Your duty to pay continues after you leave the facility. The facility pays the electricity to power the device.

State oversight and rulemaking on devices

Starting October 1, 2025, state health agencies can make rules to carry out these device rights. The Division can deny, suspend, or revoke a facility’s license for not following the device rules. These rules do not apply to devices installed by law enforcement for a legitimate investigation.
