Sponsors must provide special education at charters

The law treats charter sponsors like the local school district (LEA) for the schools they sponsor. The sponsor must provide a free public education and special education and related services to students at those charters. The sponsor must also direct the correct share of federal and state grant funds to eligible charter schools. The law also exempts related local expenses from one existing budgeting rule (NRS 354.599).

Clear timelines for charter school renewals

By June 30 before the final school year, a sponsor must give the school a report on performance and any problems. The school’s governing body may submit a written response. If the school seeks renewal, it must apply by October 15 of the final year with future plans and supporting evidence. The sponsor must decide at a public meeting and notify the school within 60 days, share the data it used, and post a summary online. Renewed contracts can last 3 to 10 years.

How the charter board runs and pays

After the initial stagger, members serve three-year terms starting July 1 and stay until replaced; vacancies are filled the same way. Members choose a Chair and Vice Chair for two-year terms starting July 1 of odd-numbered years. Voting members earn up to $80 per day for official work, plus normal state per diem and travel. New members must take onboarding training, and all voting members take yearly training on applications and governance. The board meets year-round; five voting members make a quorum that can act.

Who can serve on charter board

The state charter board has nine voting members: 2 named by the Governor, 2 by the Senate Majority Leader, 2 by the Assembly Speaker, 2 by the State Board of Education, and 1 by the Charter School Association. Appointers must pick people with charter know-how, at least one parent of a charter student, and experts in K–12, finance, management, testing, technology, and law, and seek ethnic and geographic diversity. Members must live in Nevada, and voting members must be 21 or older. Members cannot have direct money or business ties to charter schools or management groups; up to two may be teachers or administrators only if their school is in good standing.
