AN ACT relating to education; requiring the Department of Education to award money to school districts to provide compensation in addition to base pay for hard-to-fill positions in public schools; requiring school districts to report certain information relating to hard-to-fill positions; eliminating the authority in certain large school districts to use weighted funding provided to a school for certain pupils to pay certain hiring and retention incentives; revising the powers of the Subcommittee on Education Accountability of the Interim Finance Committee; making an appropriation to the Interim Finance Committee for allocation to the Department to fund compensation in addition to base pay for hard-to-fill positions in public schools; making an appropriation to provide money to charter schools for salary increases for teachers and education support professionals; and providing other matters properly relating thereto.

Extra pay for hard‑to‑fill district jobs

The state funds extra pay for hard‑to‑fill jobs in district public schools (not charter schools). Starting Oct 1, 2026, the Department of Education must run this awards program, and the money is bargained and used only for extra pay. Hard‑to‑fill means teacher jobs at Title I schools with vacancy rates at or above 15% in high school, 12% in middle school, or 10% in elementary school, or licensed teachers who are the teacher of record in English, math, science, or special education that the local board declares a critical shortage. The state sets aside $45 million in FY 2025–2026 and $45 million in FY 2026–2027, with an IFC‑approved distribution plan; unspent money must revert by Sep 18, 2026 and Sep 17, 2027. Districts must request funds by June 9, 2025 and June 8, 2026 and show each position was filled in the prior quarter. Reports are due every even‑numbered year starting Dec 1, 2026; for Dec 1, 2026, districts report only how many teachers got extra pay and the total paid. The Governor must include a funding recommendation for this program in future executive budgets.

Salary boosts for charter school staff

The state provides $19.3 million in FY 2025–2026 and $19.3 million in FY 2026–2027 for salary increases for charter school teachers and education support professionals. Each school’s share is based on its count of teachers and support staff on Oct 1, 2024 and Oct 1, 2025. Money must add to, not replace, existing pay. Charter schools must submit staffing counts, a plan by Aug 15 each year, and later reports on actual raises; the Charter School Authority compiles these and seeks IFC approval. Any unspent money must revert by Sep 18, 2026 and Sep 17, 2027.

State panel can study teacher pay

Starting July 1, 2025, the Legislature’s education accountability subcommittee may study teacher pay. It reviews whether pay is competitive with other states and how it affects student results.

Limits on using weighted funds for bonuses

Starting July 1, 2025, only districts in counties with fewer than 700,000 people may use certain weighted funds for hiring or retention incentives. Large‑county districts must use those weighted funds only for the educational programs required by law.
