AN ACT relating to health; prohibiting certain uses of artificial intelligence in public schools; requiring the Department of Education to develop a policy concerning certain uses of artificial intelligence; imposing certain restrictions relating to the marketing and programming of artificial intelligence systems; prohibiting certain persons from representing themselves as qualified to provide mental or behavioral health care; imposing certain restrictions relating to the use of artificial intelligence by providers of mental or behavioral health care; providing civil penalties; and providing other matters properly relating thereto.

Stop fake therapists and AI claims

Starting July 1, 2025, AI companies cannot claim their tools provide professional mental or behavioral health care or market chatbots as therapists in Nevada. They also cannot offer AI systems programmed to act like human clinicians. People cannot call themselves therapists, counselors, or similar titles without a valid Nevada credential. Self‑help materials are allowed if they do not claim to provide professional care, and AI built for provider admin tasks is not banned. The state Division can investigate, fine violators up to $15,000 per violation, and must share how to find licensed care and free or low‑cost crisis services. The law defines key terms so these rules are clear.

Schools limit AI in student counseling

Starting July 1, 2025, Nevada public schools cannot use AI to do counselor, psychologist, or social worker mental‑health duties. The Department of Education must set a policy for any AI used around student mental health and test its accuracy and effectiveness. Staff may use AI only for admin tasks like scheduling, records, and operational data analysis. The law also defines what counts as “artificial intelligence” for these school rules.

When these AI rules take effect

The law lets agencies start writing rules and preparing right away. All substantive requirements and enforcement begin July 1, 2025. Section 10.1 takes effect upon passage and approval.

Mental health providers' AI use rules

Beginning July 1, 2025, licensed mental and behavioral health providers may not use AI to give professional care directly to a patient. They may use AI only for admin tasks like scheduling, billing, records management, operational data, and organizing session notes. Providers must follow privacy and security laws, including HIPAA, HITECH, and NRS 439.581–439.597. They must also check AI‑generated billing or note summaries for accuracy before using them. Breaking these rules is unprofessional conduct and can lead to board discipline. The law defines which professions and services count as professional mental or behavioral health care.
