AN ACT relating to trade practices; requiring an original equipment manufacturer of certain equipment designed for a person with a physical disability to make available certain documentation, parts and tools for the diagnosis, maintenance or repair of the equipment; prohibiting an original equipment manufacturer from engaging in certain acts; exempting an original equipment manufacturer from liability for certain damage or injuries under certain circumstances; providing penalties; and providing other matters properly relating thereto.

Open repair access for mobility devices

The law requires OEMs to give owners and independent shops manuals, parts, tools, and software updates for mobility devices like wheelchairs and scooters. If the OEM has a repair arrangement, digital manuals and tools are free, and parts are sold on the same terms as to its authorized shops. If not, prices can only cover actual preparation and delivery, not research and development; printed manuals or physical tools can include those actual costs. OEMs cannot block repairs with parts pairing, add unrelated conditions, or punish shops that follow the law. Contracts cannot waive these rights. OEMs may offer training, but cannot require it, and trade secrets remain protected beyond what is needed.

OEMs not liable for third-party repairs

If a repair or modification by you or an independent shop causes harm, the OEM is not liable. This includes indirect or special damages, lost data or profits, or reduced device function. You and small repair shops carry more risk if a repair goes wrong.

Clear repair status and enforcement

When an OEM offers repairs, it is treated as an authorized repair provider for its own devices. Breaking these repair rules counts as a deceptive trade practice under Nevada law. Owners and shops can use consumer‑protection remedies to enforce their rights.
