Faster Medicaid rules and retroactive fixes

The Division can give only 3 business days’ notice for a rule change that is needed to follow federal or state law or that expands services or benefits. For any other change, it must give at least 30 days’ notice. The Administrator may make a rule apply to a past date only when that is needed to comply with law. The rule must clearly say it is retroactive and list the exact past date. This can change past eligibility, bills, or payments in Medicaid programs.

Clearer notices and input on Medicaid rules

Notices must explain why a rule is needed and show the rule text or the topics involved. They must say how and when people can comment, who may be financially affected, and any local government impact. Notices must list where to read the full text and be mailed to people on the Division’s mailing list. Everyone must have a fair chance to give oral or written comments, and the Administrator must consider them. The Division must keep minutes and an audio recording or transcript of each hearing and give copies for free on request.

Two-year deadline to challenge Medicaid rules

You have only 2 years after a rule takes effect to object based on notice-and-comment procedures. After that, procedural challenges to Medicaid and other Division program rules are barred.
