Annual $25 million cap on job orders

Beginning July 1, 2025, each public body can award up to $25 million in job order contracts per year. Any unused amount from one year may be added to the next year’s limit. This cap can reduce total work available through job orders when demand is high.

Stricter rules for job order contractors

Beginning July 1, 2025, contractors must meet eligibility rules, including proper state licenses, bonding, financial strength, a safety program with drug testing, and no recent disqualifying breaches. A contractor may not self‑perform more than 50% of a job order’s estimated cost and must hold the right specialty licenses for trades. The prime must hire and oversee qualified subcontractors and ensure they follow state rules. Before a job order is issued, the contractor must list intended subcontractors and can replace them only under limited legal grounds.

Prevailing wages and apprentices on job orders

Beginning July 1, 2025, job order contracts must pay prevailing wages to all non‑apprentice workers. At least 25% of workers must be registered apprentices or graduates, unless the public body grants a waiver after you show diligent efforts, or a qualifying project labor agreement applies. Contractors must monitor and prove compliance.

New job-order contracting for big localities

Beginning July 1, 2025, only large counties, big cities in those counties, and certain improvement districts may use job order contracts for minor work on existing public works. Requests for proposals must include a unit-price catalog, an adjustment factor, scoring factors, bonding rules, and renewal pricing. A review panel with construction experience scores bids, and a 5% weight applies for a valid bidding-preference certificate unless it risks federal aid. Applicant names are public, but bid contents stay confidential until a notice of intent to award. Each public body must adopt a written policy for assigning job orders after a public hearing.

New data and reports on job orders

Beginning July 1, 2025, covered public bodies must collect data on job order contracts and send quarterly reports to their governing body. Governing bodies must send an annual report to the Legislative Counsel Bureau at session start and to the Legislative Commission by February 1 of even‑numbered years. These reporting rules are exempt from the usual preclearance step, which speeds implementation.
