More notice and analysis for small businesses

State agencies must check early if a proposed rule puts a big burden on small businesses. If it does, they must talk with owners, notify chambers and trade groups, and analyze the impact. They must consider ways to cut harm, like simpler rules, different standards for small firms, or lower fees and fines for small businesses. A Small Business Impact Statement must be public at least 15 days before the workshop and the hearing. It must estimate businesses affected, list costs and benefits, enforcement costs, and any yearly fee revenue and how that money will be used. A senior official must sign it, and the agency must include it with notices and the adopted rule, and explain any later changes. Agencies must hold at least one workshop before the first hearing, give 15 days’ notice by mail and email, keep an email list updated by January 31 each year, and cannot hold the hearing on the same day as the workshop.

Tougher rules for local business fees

Local fee changes that businesses pay, including impact fees, now count as rules. They must follow rulemaking protections like notice, analysis, and small‑business impact checks. If a local board adopts a rule without following these laws, it is void and cannot be enforced. For impact fees, the board must set a public hearing at least 20 days out. It must publish notice once a week for two weeks, post it at the main office and three other places, and, when possible, send it to chambers and trade groups. The notice must list the time, date, and place, explain the purpose, include a service‑area map, and say anyone may present evidence.
